Quick answer

A Perth caveat loan is a short-term business loan secured by a caveat that the lender lodges with Landgate over property you own, often behind an existing mortgage. Since August 2023 WA no longer uses paper duplicate titles, so the lender relies on its caveat and signed documents rather than holding a title. Loans are sized on equity and a clear exit, typically over a few weeks to a year.

Key points

  • WA abolished paper duplicate certificates of title on 7 August 2023, so holding a paper title no longer gives any lender security
  • Under section 138B of the Transfer of Land Act 1893, an owner can apply to remove a caveat and the caveator has 21 days to obtain a Supreme Court order
  • Perth's resources-linked economy creates big contract wins and sudden slowdowns, both of which drive short-term borrowing
  • WA payroll tax applies once annual wages pass $1m, the lowest threshold of the mainland states

Plenty of Perth owners still have a crisp paper certificate of title tucked away in a filing cabinet, and some private lenders used to ask for exactly that piece of paper as security. Since August 2023 it’s worth nothing more than sentimental value. That change, and a few other Western Australian rules, shape how caveat loans work in Perth today.

This page is for Perth business owners weighing a short-term loan against property. It covers the WA title system, the rules on removing a caveat, how the local economy feeds demand and what to expect on cost. We have no office in Perth or anywhere in WA. Enquiries come to us online and by phone, and Landgate dealings are lodged electronically.

What changed when WA scrapped duplicate titles?

Landgate is Western Australia’s land registry. For decades, the registered owner could hold a paper duplicate certificate of title, and handing it to a lender was a common informal way to show good faith on a private loan.

Amendments to the Transfer of Land Act took effect on 7 August 2023 and removed duplicate titles from the system. Landgate no longer creates or issues them, existing paper copies have no legal effect, and they aren’t needed to register any land transaction. Ownership is now proven through identity verification and the right to deal, usually by a lawyer, settlement agent or bank.

For borrowers, the effect is simple. A lender’s protection in a Perth caveat loan comes from the documents you sign and the caveat it lodges with Landgate. If someone ever suggests handing over a paper title as security, that’s a sign they’re working from an out-of-date playbook. Landgate also notes that caveats never appeared on duplicate titles anyway, so a title search is the only reliable way to see what’s registered.

How a lender’s caveat is lodged and removed in WA

When a Perth caveat loan is approved, you sign a loan agreement and usually a charge or unregistered mortgage over the property. Landgate then records the lender’s caveat, which guards that interest. From then on, anyone searching the title sees the claim, and the property can’t easily change hands without the lender being repaid at settlement.

Removal usually happens the easy way: you repay, and the lender lodges a withdrawal. But WA also has a formal process. Under section 138B of the Transfer of Land Act 1893, the registered owner (and in some cases a judgment creditor or mortgagee in possession) can apply to have a caveat removed. Landgate serves notice, and the clock starts: within 21 days the caveator must secure an order from the WA Supreme Court backing its claim and file it with Landgate. If it doesn’t, the caveat lapses. Some caveats, such as those lodged under a court order, can’t be removed this way.

For a borrower in a signed loan, this isn’t a shortcut out of the deal, since a lender with valid documents will defend its position. It matters more if you’re selling during the term: our guide to what happens to a caveat when you sell covers the practical steps.

Why Perth businesses reach for caveat loans

Perth’s economy is closely linked to the resources sector. Head offices, engineering firms and the mining equipment, technology and services (METS) suppliers clustered in Welshpool, Kewdale, Malaga and Bibra Lake all ride the same cycle. When projects ramp up, suppliers need cash to fund stock, staff and mobilisation before the first invoice is paid. When they slow, a lost contract can leave a gap that takes months to fill.

Other regular sources of Perth enquiries:

  • Marine and defence work around Henderson and the Australian Marine Complex, where large contracts come with long payment chains.
  • Construction and trades, especially subcontractors in the growth corridors to the north and south.
  • Hospitality and retail in Northbridge, Leederville, Fremantle and the CBD, after a fit-out overrun or a slow season.
  • Payroll tax bills. As at October 2026, WA payroll tax applies once annual wages pass $1m, the lowest threshold among the mainland states, and the deduction tapers away for larger employers.

Where the problem is short-lived and the owner holds equity in real estate, a caveat loan is often the quickest way to cover it.

A checklist before you apply

Perth caveat lenders move quickly when the basics are ready. Have these to hand:

  • The property address, its rough value and the balance owing on any mortgage
  • Photo ID for every registered owner, and trust or company documents if relevant
  • Evidence of the business purpose: an ATO or RevenueWA notice, a supplier invoice, a contract
  • A clear exit: the sale, refinance, invoice or refund that will repay the loan, with a date
  • Recent business bank statements, if the lender asks for them

Then test the numbers. Our caveat loan calculator shows how a loan amount changes your combined loan-to-value ratio and the total dollar cost across the term.

What lenders think about Perth property

Metropolitan Perth houses and townhouses are straightforward for most caveat lenders. Apartments are usually fine, though some lenders prefer to avoid very small units. Property outside the metro area is another matter: many lenders restrict how much they’ll advance in mining towns and remote regions, which is why owners with a Pilbara home and a Perth investment unit usually lead with the Perth property. Our Pilbara business loans page explains why.

What it costs

Rates aren’t published in this directory. Look instead at the total you’ll pay in dollars over the expected term: an establishment fee, monthly interest (sometimes capitalised), legal costs, valuation and Landgate fees for lodging and withdrawing the caveat. Shorter terms and modest amounts keep that total sensible.

For needs longer than a year, compare a second mortgage in Perth, which is generally cheaper over a longer period.

A Perth example

A made-up scenario to show how the pieces fit.

A furniture importer in Malaga has three containers of stock landing before the Christmas trading period, with $210k in freight, duty and GST due before anything can be released from the wharf. Its trade finance facility is already fully drawn, and the bank wants six weeks to review a limit increase.

The owner holds a house in Duncraig worth about $1.4m with $520k owing. A caveat lender agrees to $210k for four months, secured by a caveat lodged with Landgate. The stock clears, December sales run strongly, and the loan is repaid from trading cash in February. The owner knew the total dollar cost upfront and weighed it against missing the season.

Banks remain the first stop

Perth’s banks are competitive lenders against property, and for a business with clean financials and time, their offer will usually be the cheapest. If your bank can approve inside your deadline, take it seriously.

A caveat loan fits when the bank can’t move fast enough, when tax debt or a past default has made it hesitant, or when the need is only a few months long. The wider Perth business loans page covers unsecured, invoice and equipment options. If a dispute with a landlord, supplier or principal contractor is part of the story, WA’s Small Business Development Corporation offers free advice and low-cost dispute resolution.

Frequently asked questions

I still have a paper certificate of title for my Perth property. Does it matter?

Not legally. Since 7 August 2023, paper duplicate titles in WA have had no effect and aren't needed to register a dealing. Keep it as a keepsake if you like, but a lender won't ask for it and holding it gives nobody a claim over your land.

How does a caveat get removed in WA after I repay?

The lender lodges a withdrawal of caveat with Landgate once the loan is paid out. If a caveat ever needs to come off without the caveator's cooperation, an owner can apply under section 138B, which gives the caveator 21 days to obtain a Supreme Court order or lose the caveat.

Can I get a caveat loan on a property outside Perth, such as in the Pilbara?

Sometimes, but many lenders limit lending in mining towns and remote areas. A Perth metropolitan property is far easier to secure against. Our Pilbara page explains how lenders view regional WA property.

How fast can a caveat loan settle in Perth?

When the property and paperwork are straightforward, it can be the same day or within a couple of business days. Valuations, ID checks and signatures take most of the time; Landgate lodgement itself is quick.

Can I use a caveat loan to pay a payroll tax debt to RevenueWA?

Yes, clearing a state tax debt is a business purpose. Lenders will want to see the debt and know how the loan will be repaid at the end of the term.
